Welcome to TagNest ("Application", "Service"). These Terms of Use ("Terms") govern your access to and use of the Application provided by Robert Kuna ("Service Provider", "Company"). By using the Application, you agree to comply with these Terms. If you do not agree with these Terms, do not use the Application. This service is intended for use "AS IS".

By accessing or using the Application, you confirm that you have read, understood, and agreed to be bound by these Terms. The Service Provider reserves the right to modify these Terms at any time, and your continued use of the Application signifies your acceptance of any such changes.

• The Application is provided "AS IS" and is intended for personal and commercial use.
• You agree not to misuse the Application or assist anyone in doing so.
• You must be at least 13 years old to use the Application. You are responsible for maintaining the confidentiality of your account credentials.

• You may be required to register an account to access certain features of the Application.
• You agree to provide accurate and complete information when creating an account.
• You are solely responsible for any activity that occurs under your account.

• The Application may offer subscription-based services with monthly and annual billing.
• Payments are processed through third-party services (e.g., RevenueCat) and are subject to their terms and policies.
• No refunds are provided unless required by law.

• The Service Provider retains all rights, title, and interest in and to the Application, including but not limited to all intellectual property rights.
• You may not copy, modify, distribute, sell, or lease any part of the Application.

Your use of the Application is also governed by the Privacy Policy. By using the Application, you consent to the collection and use of your data as described in the Privacy Policy.

• Use the Application for any illegal or unauthorized purpose.
• Interfere with or disrupt the integrity of the Application.
• Attempt to gain unauthorized access to any portion of the Application.

The Service Provider reserves the right to suspend or terminate your access to the Application at any time for any reason, including but not limited to a breach of these Terms. Upon termination, your right to use the Application will cease immediately.

To the maximum extent permitted by law, the Service Provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Application. In no event shall the Service Provider's aggregate liability exceed the amount you paid to the Service Provider, if any, in the past six months for the Application. To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of this Terms), even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose. Some states do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, which means that some of the above limitations may not apply. In these states, each party's liability will be limited to the greatest extent permitted by law.

These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law principles.

Application is provided to You "AS IS" and "AS AVAILABLE", with all faults and defects, and without warranty of any kind. To the maximum extent permitted under applicable law, TagNest, its owners, affiliates, licensors, and service providers expressly disclaim all warranties, whether express, implied, statutory, or otherwise, with respect to the Service, including but not limited to all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, as well as any warranties that may arise out of course of dealing, course of performance, usage, or trade practice. Without limitation to the foregoing, TagNest makes no warranty or representation that the Service will meet Your requirements or achieve any intended results, be compatible or work with any other software, applications, systems, or services, operate without interruption or meet any performance or reliability standards, or be error-free, or that any errors or defects can or will be corrected. Neither TagNest nor any of its providers makes any representation or warranty, express or implied: (i) As to the operation or availability of the Service, or the information, content, and materials provided therein; (ii) That the Service will be uninterrupted or error-free; (iii) As to the accuracy, reliability, or currency of any information or content provided through the Service; (iv) That the Service, its servers, content, or emails sent from or on behalf of TagNest are free of viruses, scripts, trojan horses, worms, malware, timebombs, or other harmful components. Some jurisdictions do not allow the exclusion of certain types of warranties or limitations on statutory rights of a consumer. In such cases, the exclusions and limitations set forth in this section shall be applied to the greatest extent enforceable under applicable law.

The Application may contain links to third-party websites or services that are not owned or controlled by the Service Provider. The Service Provider has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that the Service Provider shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

The Service Provider may update these Terms from time to time. Continued use of the Application after such changes shall constitute your consent to the revised Terms. It is your responsibility to review these Terms periodically for any changes.

If You have any concern or dispute about the Application, you agree to first try to resolve the dispute informally by contacting the Company.

If you have any questions or suggestions about our Terms and Conditions, or have questions about the practices, please contact the Service Provider via email at tagnestapp@gmail.com. When contacting us (e.g. via contact form or e-mail), personal data is collected. This data is stored and used exclusively for the purpose of answering your request or for contacting you and the associated technical administration. The legal basis for the processing of this data is our legitimate interest in answering your request in accordance with Article 6 (1) (f) GDPR. If your contact is aimed at concluding a contract, the additional legal basis for processing is Art. 6 (1) (b) GDPR.

By using the Application, you acknowledge that you have read these Terms, understand them, and agree to be bound by them.
